This paper presents results of our research on the process of building development intensification within the Niepołomicka Forest surroundings in 1978-2003, and spatial policies of communes in relation to those areas, as well as results of those policies. Our research demonstrated diversification in the types of spatial structure transformation processes occurring in various parts of the metropolitan area, a considerable influence of even small but ecologically susceptible areas on the natural spatial structure of development, as well as justifiability of determining natural functional areas for the coordination of spatial policy on a trans-local level, in particular within metropolitan areas subjected to strong investment pressures.

The paper suggests legal procedures securing the interest of land owners in conflict areas (areas where the land use does not correspond with the possibility of a better use of the ground), in the case of redevelopment of the utilization structure of those areas — redevelopment programmed, designed and carried out by the agencies of public authorities. There are several techniques of realization of this process, all of them aim at such a redevolopemnt of immovables parameters so that they can be better and more comprehen­sively prepared for performing a new function. It is obvious that such a considerable redevelopment involves serious legal problems - especially with regard to the right of property and use of grounds subject to the redevelopment process. This paper presents a proposal of a legal procedure for starting such an undertaking based on technological assumptions of the Japanese redevelopment system called KUKAKU-SEIRI, the characteristic feature of which is "self-financing" of the whole process, and based on the principles securing the legal aspect of the undertaking: the principle of superiority of the social interests over interests of the individual, the principle of equal treatment of all redevelopment participants, the principle of public inspection before completing each redevelopment stage, the principle of just share in distributing new grounds, the principle of adequate compensation of material and moral damages, the principle of application of expropriation only as an absolute necessity.

Praca prezentuje teoretyczne i praktyczne problemy transformacji użytków w celu zalesień i zadrzewień w aspekcie najnowszych rozstrzygnięć prawnych oraz wymogów kompleksowo pojętej restrukturyzacji obszarów wiejskich. Punktem wyjścia przy określa­niu obszarów do zalesień jest zaprojektowanie granicy rolno-leśnej jako ważnego elementu treści miejscowego planu zagospodarowania przestrzennego. Propozycję zasad i procedury projektowania takiej granicy zweryfikowano na obiekcie badawczym.
