The obligation of compliance of food packaging is regulated by the Regulation (EC) No. 193512004 (the "Framework Regulation"). For plastic food packaging declaration should confirm the compliance with the requirements of EU Regulation No 10/2011 (the "Plastics Regulation"). In the case of materials and articles intended to contact with food, for which not yet been established in the European Union specific regulations, issuing declaration of compliance is not mandatory. This can be done on a voluntary basis, which is very often used in practice. In the case of coating, inks and adhesives, which are used in the production and become part of plastic food packaging, there is an obligation to provide adequate information about their constituent substances which are subject to restrictions under the provisions of the Plastics Regulation. Despite the fact that the declarations of compliance shall be issued for a long time, still a suppliers of the products (final packaging, plastic intermediate materials, non-plastic intermediate materials and chemical substances) and their customers have doubts, what they should contain and what documents are required to confirm their compliance with the safety requirements of the health. Documents confirming compliance (called the Supporting Documents) are not passed along the supply chain, but should be kept by the business operator and presented, on request, the relevant authorities, including the official control bodies of food packaging and food under the Regulation (EC) No. 882/2004.
