According to the Treaty on the Functioning of the European Union, “the Union shall define and implement a common agriculture and fisheries policy." Aquaculture is one of the elements of this policy, and it is viewed as having immense potential in guaranteeing consumers supplies of fish products without negatively impacting the natural environment. An analysis of the development of aquaculture over the past decade prepared for the ongoing reform of the Common Fisheries Policy (CFP) indicated that no progress is being made in the development of breeding or rearing fish. In accepting in July 2011 the Conclusions package which comprise projects for new CFP regulations, the Commission proposes a greater degree of regulation in aquaculture than has been applied to date. New solutions for aquaculture include above all else new management mechanisms for the sector. This article analyses the development of EU legal regulations for aquaculture from the most recent CFP reform and presents the instruments proposed by the Commission that were published in the July 2011 legislative package.
