Prawne aspekty leśnictwa miejskiego w Polsce

In Poland, the public believes that the main objective of urban forests is rather to conduct forest management focused on the recreational needs of residents than to produce timber. Considering this belief, it becomes reasonable to distinct the principles of forest management in urban forests from those related to the forests of the State Forests National Forest Holding. Because of the permanent presence of people in the city woods, the managing authorities of such areas should also educate the residents, while forest management should be subordinated to social functions, especially the recreational one. However, Poland lacks the unified system of managing the urban forests, not only at the national scale (there is no central independent organizational unit), but also at the level of individual cities, where various municipal units manage urban woodlands. In practice, each city has its own, individual solutions in this regard. The governing bodies of urban forests face with many problems in their activity. These problems are associated with a strong process of urbanization and human pressure on forest areas, while on the other hand there are no formal legal basis (laws, regulations, instructions) relating the municipal forests. The paper reviews the literature on urban forestry and urban forests worldwide to present the existing legislative frameworks and to propose some changes, based on the current Act on Forest. It was stated that urban forestry in Poland is located in its ‘narrow' definition, based on the traditional forestry, giving priority to the multiple social functions. The proposed changes in forest legislation are part of the discussion on municipal forests and urban forestry in Poland, aiming once again to draw attention to the fact that they are almost ignored in the Polish legislation. The indicated areas for improvements and supplements suggest issues the most important and urgent to solve, but they are not a comprehensive solution on this subject. In order to strengthen the supervision of urban forests in Poland, it is essential to consider the restoration of central supervision, coordinating activities of urban foresters by the development and implementation to the practice unified legal regulations, as well as to give wide autonomy to cities.
Podjęto próbę oceny kierunków i skali zmian w poziomie dochodów rolniczych na osobę pełnozatrudnioną w Unii Europejskiej i w poszczególnych krajach członkowskich. Przeprowadzone badania potwierdziły występowanie zjawiska zmienności dochodów. Wykazano również, że w tych samych warunkach sytuacji zewnętrznej (europejskiej i pozaeuropejskiej) poszczególne kraje odnotowywały odmienne kierunki i skale zmian sytuacji dochodowej ludności rolniczej. W tym samym roku w jednych krajach dochody te rosły, w innych spadały. W większości krajów członkowskich, w tym w Polsce, w latach 2005-2014 obserwowano pozytywne, długookresowe trendy kształtowania się dochodów rolniczych w przeliczeniu na osobę pełnozatrudnioną.
In the paper the long term dynamics (about 40 years) of selected, the most important, natural forest stands of the Białowieża Forest were presented. The studies were carried out on 120 permanent study plots, located both in nature reserves and in the Białowieża National Park. The DBH of all the trees were measured and the number of all the individuals trees and shrubs species with the height under 1,3 m was counted. The analysis of tree species composition and their density changes was carried out, as well as their natural regeneration was analyzed. The strong expansion of hornbeam were observed (fig. 1a, b; tab.). Actually this species was predominant in forest stands, in natural regeneration and was expansive to the more oligotrophic and mezotrophic forest stands, causing their unification towards hornbeam forest. Norway spruce generally declined in abundance and became limited to oligotrophic forest communities. Significantly reduction this species were observed, especially on the mixed coniferous forest at mixed deciduous forest stands. Scots pine, oak and birch declined their share in forest stands, as well as their natural regeneration have been limited too (tab.). In the short time of the last 15 years, the strong reduction of ash share in forest stands has been observed, and the more rapid changes in all the forest stands composition as well.

Over the last years, criticism of the State Forests policy has been becoming more and more frequent in the press. For that reason it is very important to inspire changes in the State Forests organisation system that will result in its adaptation to the changing requirements of the social market economy. From the economic point of view one of the most important problem is that the State Forests is an economic organisation without legal personality. This fact facilitates unjust criticism of this entity that leads to restriction in its economic activity and eventually decreases maximum gains from its resources. We present trends of changes from status quo across legitimate company to joint stock union and the budget unit. It is proposed to confer legal personality on the forest economic units so they become legitimate companies. Moreover it is also suggested to use the State Forests profits as evaluation criteria of its economic activity. The generated profits should be sufficient to protect owner (i.e. the state) interests and is intended to implement them to achieve important social and economic features. In addition, a new motivation system based on the incomes considering the interest of the state, company and the employers should be developed. In order to reduce conflicts that arise from limited ability to use environmental and social functions, efforts should be made to precisely determine leading functions of chosen forest areas. The main goal of the proposed legal and organizational reform of the State Forests is to create conditions to generate higher legal revenues from various from of forest activity and allocate them for implementation of non−economic forest functions. This would make possible to achieve greater social acceptance of actions made by the franchise.
