The Nature Conservation Act in its present form (2013) allows for the removal, without permission of the respective offices, of trees and shrubs whose age has not exceeded ten years. Against this background many misunderstandings and disputes arise between the property owners and the authorities, as the parties’ opinions regarding the age of the trees removed are divergent. Determining the age of trees with an accuracy of up to one year is difficult even for dendrologists. Too many factors affect the variability in growth of trees even within the same species or variety. Due to the increasing number of contentious issues the assessment criterion is planned to be changed, i.e. replacing the age of trees with the trunk breast height circumference divided into two groups of species: fast growing and the rest. The article contains the results of a survey addressed to the municipal authorities in Poland (administrative units issuing permits for the removal of trees) on determining the age of trees.
