The current veterinary legislature on aquaculture was developed 20 years ago when the European Union consisted of only 12 Member States. It was created in order to protect the-then basic field of activity of this sector, which was the culturing of salmonids (trout and salmon) and oysters. Currently, this law requires updating so as to reflect the wide scope of activity within the aquaculture sector and species now found in the enlarged Union. It should also include significant developments in this branch and the experience gained through the last 15 years of implementing the existing law and scientific progress in this discipline. EU regulations should also be updated to conform to international agreements and norms (e.g.: WTO/SPS and OIE). The proposed new regulations submitted to the Council will abolish the present laws (Council directives 91/67/EEC, 93/53/EEC and 95/70/EC) and replace them with a new directive on health requirements for aquatic animals and products thereof, and on the prevention and control of certain diseases in these animals. This will facilitate higher flexibility and give operational responsibility to the Member States, thus enabling effective disease prevention through initiating decision-making at a local or regional level.
The history of legal protection of animals in Poland dates back to the early 20th century. The legal solutions adopted at that time in the form of regulations of the President of the Republic of Poland and acts of the Parliament were in force for decades. The turn of the 20th century brought some dramatic changes in this regard. Parliamentary acts, both newly passed and amended, harmonised Polish law with European standards; many legal acts have been passed in Poland since 1 May 2004 which were adopted throughout the European Union. The most important legal act which protectanimals against suffering inflicted by humans is the Animal Protection Act of 1997. The Act, amended many times, together with the law of 2015, which protects laboratory animals, laid thegrounds for legal and administrative actions against people who violate its provisions. This law isamended in line with scientific findings regarding the feeling of pain by animals. This paper analyses the flaws in the current laws from a veterinary surgeon standpoint
The Veterinary Inspection (VI) has been, by virtue of law, equipped with a number of controlling competencies. This evaluation involved the operational activities of 50 districtveterinary inspectorates in 2008–2012 in the following provinces: Warmińsko-Mazurskie,Śląskie, Wielkopolskie, and Lubelskie. The effectiveness of administrative decisions on the discovered cases of undesired events in the controlled entities was performed. The results are representative for the whole country. The analysis of the data indicates a need for an increasednumber of controls and for improving controls and for improving their quality. Continuous monitoring of supervised entities and analysis of the data provide a basis to reduce undesiredevents
