Opracowanie prezentuje analizę gmin w Polsce pod kątem sporządzanych opracowań planistycznych w postaci studium uwarunkowań i kierunków zagospodarowania przestrzennego oraz miejscowego planu zagospodarowania przestrzennego. Analizie poddano również koszty sporządzenia lub zmiany dokumentów planistycznych w poszczególnych województwach, oraz charakterystykę wydanych pozytywnych decyzji o ustaleniu lokalizacji inwestycji celu publicznego i o warunkach zabudowy i zagospodarowania terenu. Badaniami objęto lata 2004-2010 opierając się na danych Głównego Urzędu Statystycznego, pochodzących z ankiet „Planowanie przestrzenne w gminach".

The object of article is the evaluation of formal, legal and practical aspects of functioning of the procedure of strategic evaluation of environmental impact of communal spatial planning acts - studies of land use conditions and directions of the commune as well as local spatial development plans. The work involved the analysis of effective provisions, primarily of the act on the access to information on the environment and its protection as well as on evaluation of environmental impact and of the act on spatial planning and development and the Code of Administrative Proceedings. The consultation obligation with competent authorities within the strategic evaluation of environmental impact results in the first place from Article 9 of the Kiev Protocol to the Espoo Convention and Article 6 of the Directive 2001/42/EC. However, the application of Polish regulations involves numerous interpretation doubts - primarily those resulting from the necessity to use the provisions of different acts. That is why, in the article, the guidelines presented by the doctrine and judicial decisions of administrative courts as regards the application of provisions were pointed out and conclusions were formulated concerning the improvement of procedures of cooperation between competent administration authorities.

This publication presents the analysis of communal urban planning documents for the Pagory Chelmskie area with regards to their contents on the protection and development of the landscape. It pays special attention to the issue of agricultural landscape protection and the aesthetic values of the main elevations. The results of the conducted analyses prove that this subject is rarely researched and treated very generally, even in the studies of conditions and communal development plans. The idea of a landscape only shows up in the context of natural qualities and listed monuments, which is why recommendations regarding landscape protection and development are sometimes conflicting and often contribute to the decay of aesthetic values. The publication includes also, in addition to the assessment of studies and local plans, a proposal of changes in the way of preparing urban planning documents for this area. Select ways of landscape protection and development of the most valuable hills have also been specified.
