The subject of this paper is connected with the prohibition of misleading consumers in the presentation of dietary supplements. Judicial decisions indicate that the prohibition of misleading consumers is frequently infringed in the presentation of dietary supplements by the use of prohibited references to medicinal properties of these products. The paper discusses issues concerning the relationships of the prohibition of misleading consumers with the concept of food safety based on the example of dietary supplements. In conclusion the author states that the prohibition of misleading consumers creates in food law a certain buffer – blocking the possibility for the occurrence of situations undesirable from the point of view of consumer health and life or obstacles for the free selection of products, thanks to which it becomes an essential element in food safety management. In turn, infringement of this prohibition may determine the evaluation of products in terms of their safety.

In the paper, legal protection of terms used to indicate organic agriculture products is analysed in the light of two Council Regulations (EC) No 834/2007 and 889/2008, and two acts: on combating unfair competition and combating unfair market practices. An attempt to determine whether the legislator has sufficiently provided for such protection is also made. In conclusion it is stated that although fair information on organic products is legally provided for, the protection of the terms used in the marking of those products varies. Community Regulations do not precise the "irregularities, or infringements' of the manner in which that information is to be provided. This, in turn, may lead to different interpretations of the same law, and may consequently result in unequal treatment of producers throughout the Community. Polish regulations have been found to sufficiently cater for the provision of information and the terms used to mark organic products. The existing regulations could, nevertheless, be still more effective if they contained a separate list of examples of unfair competition (i.e. infringements of the principles of providing information on organic products).

Organic farming forms a significant part of Community policy on quality of agricultural products. The control system in organic farming belongs to specific systems guaranteeing agricultural product quality. The activity of control bodies in organic farming is highly important both for producers and consumers. The aim of considerations is to determine the legal status of control bodies in control system of organic farming. For this reason, the Author analyzes premises for control bodies participation in organic farming control system together with duties and powers attributed to them. The Author concludes inter alia, that Regulations (EC) No 834/2007 and 889/2008 together with the draft Polish law on organic farming do not clearly set the legal status of control bodies. This refers to their role against public authorities when carrying out control in organic farming and the legal character of activities taken by them towards economic operators.
