Payments and annual fees for the exclusion of land from agricultural production are the basic financial and legal instruments for the protection of agricultural land. The effectiveness of these instruments is determined by the level of binding legal regulation manifested by the scale of interpretation discrepancies. The subject of this article is to present those elements of the institution of fees for the exclusion of land from agricultural production which provokes the greatest controversy in the process of applying legal norms and to propose possible legislative solutions.
