W pracy przedstawiono problematykę związaną z przepisami prawnymi dotyczącymi ochrony gruntów rolnych w Polsce. W tym celu wyjaśniono podstawowe definicje, wynikające z przepi¬sów ustawy z dnia 3 lutego 1995 roku o ochronie gruntów rolnych i leśnych, do których zalicza się przede wszystkim: przeznaczenie gruntów rolnych na cele nierolnicze, wyłączenie gruntów rolnych z produkcji rolniczej, degradację i rekultywację gruntów rolnych, a także Fundusz Ochro¬ny Gruntów Rolnych (FOGR). Ukazano również sposoby ochrony gruntów rolnych, wynikające z przepisów wspomnianej ustawy, a także zwrócono uwagę na szczególny obowiązek ochrony gruntów rolnych najwyższych klas bonitacyjnych, tj. klas I-III, których przeznaczenie na cele nierolnicze wymaga uchwalenia miejscowego planu zagospodarowania przestrzennego oraz zgo¬dy Ministra Rolnictwa i Rozwoju Wsi. Omówiono także skutki wynikające z nowelizacji ustawy o ochronie gruntów rolnych i leśnych, jaka miała miejsce z dniem 1 stycznia 2009 roku, do których należy zaliczyć przede wszystkim brak możliwości ochrony użytków rolnych położonych w granicach administracyjnych miast.

This paper presents the legislative aspects of agricultural land protection in Poland. To this aim clarification has been given to the fundamental definitions based on the regulations of the Act on Protection of Agricultural and Forest Land, such as non-agricultural use of agricultural land, exclusion of agricultural land from agricultural production, degradation and reclamation of agricultural land, as well as the Agricultural Land Protection Fund. The paper also describes the agricultural land protection methods imposed by the above mentioned Act and emphasises specific responsibility to protect soils of the highest valuation, classes I—III, for which non-agricultural use requires a local spatial development plan to be adopted and the approved by the Ministry of Agriculture and Rural Development. The study also determines the outcomes of the amendment to the Act on Protection of Agricultural and Forest Land introduced on 1st January 2009, which principally consist in that the protect arable land within the administrative limits of towns cannot be protected.
