EN

The subject of this paper is connected with the prohibition of misleading consumers in the presentation of dietary supplements. Judicial decisions indicate that the prohibition of misleading consumers is frequently infringed in the presentation of dietary supplements by the use of prohibited references to medicinal properties of these products. The paper discusses issues concerning the relationships of the prohibition of misleading consumers with the concept of food safety based on the example of dietary supplements. In conclusion the author states that the prohibition of misleading consumers creates in food law a certain buffer – blocking the possibility for the occurrence of situations undesirable from the point of view of consumer health and life or obstacles for the free selection of products, thanks to which it becomes an essential element in food safety management. In turn, infringement of this prohibition may determine the evaluation of products in terms of their safety.

L’oggetto dell’articolo è il divieto di indurre in errore il consumatore sulle caratteristiche degli integratori alimentari. Le sentenze dei tribunali dimostrano che il divieto di indurre in errore viene spesso violato nella presentazione degli integratori alimentari tramite l’uso dei riferimenti, vietati dalla legge, alle proprietà curative dei prodotti. Nell’articolo vengono discusse le questioni dei rapporti del divieto di indurre in errore con il concetto di sicurezza alimentare sull’esempio degli integratori alimentari. In conclusione, l’Autrice afferma che il divieto di indurre in errore crea nel diritto alimentare un vero e proprio „tampone” – blocco per l’insorgere delle situazioni indesiderabili dal punto di vista della salute e della vita del consumatore oppure soltanto dell’ostacolo alla libertà di scelta dei prodotti, diventando così un elemento importante nella gestione della sicurezza alimentare. Invece la violazione di tale divieto potrebbe pregiudicare la valutazione del prodotto sotto l’aspetto della sua sicurezza.
