Conflicts between the planned Natura 2000 network and the indispensable road investments in Poland are intensifying. The biggest such conflict is the controversy about running the ring road of the famous tourist locality of Augustów through the Rospuda River valley to be included in the Natura 2000 Ecological Network. Taking part in the controversy are ecological organisations and some scientific communities on the one hand, and organs responsible for the construction of national and international roads and Augustów residents, on the other. Independently of the natural reasons, the most important is the procedural controversy to which the European Commission is a party. It boils down to answering the question whether taking the finał decision on the admissibility of the investment project from the point of view of environment protection, the minister of the environment ordered to carry out all the necessary analyses and based his decision on strong substantial premises. The non-government organisations suing the minister' sdecisions to the European Commission insist that this was not the case, while the minister himself presents proofs testifying to the law-abidingness of his decisions. The case is now in the European Tribunal. The situation is additionally complicated by the fact that, according to Polish law, the basic procedures for the localisation of the investment project were completed still before Poland's accession to the EU and that it was included in the local spatial development plans. Based on these facts, local communities do not want to agree to any changes in the run of the ring road. The article concentrates on conclusions stemming from the described situation to avoid conflicts of similar type in the future. The author recommends a number of legal and organisational solutions, e.g. streamlining of the system of spatial development, strict observance of the legal procedures and engaging the society and the interested social organisations in the process of searching for the best runs of road investment projects through areas of especially precious natural values.
