Przedmiotem artykułu jest analiza prawnych aspektów dotyczących możliwości oraz trybu wnoszenia przez społeczeństwo uwag i wniosków w strategicznej ocenie oddziaływania na środowisko, sporządzanej dla projektów gminnych aktów planowania przestrzennego (studium uwarunkowań i planu miejscowego). Wejście w życie ustawy z dnia 3 października 2008 r. o udostępnianiu informacji o środowisku i jego ochronie, udziale społeczeństwa w ochronie środowiska oraz ocenach oddziaływania na środowisko spowodowało wiele wątpliwości interpretacyjnych, które wymagają wyjaśnienia. Artykuł porusza również zagadnienia związane z dostępem do informacji o środowisku w toku sporządzania studium uwarunkowań i planu miejscowego.

In spatial planning, the adopted solutions should be analysed in terms of their possible impact on the environmental balance and durability of natural processes in the environment, in addition to the assessment of development needs of local communities. This is the purpose of the strategic assessment of environmental impact. Social participation is important in this regard. Consequently to the entering in force of the law of 3rd October 2008 on providing information on the environment and its protection, social participation in protecting the environment and assessments of environmental impact, three procedures have been superimposed in course of developing studies on the terms and local development plans: 1) Procedures of developing and adopting studies of terms/ local development plans done on basis of the law on spatial planning and development;Performed as part of the above, the procedure of strategic assessment of environmental impact, in line with the law on providing environmental information; 2) Social participation in the procedure of strategic assessment of environmental impact, in line with the law on providing environmental information. 3) An analysis of regulations leads to the conclusion that society has the right to present "environmental" remarks and motions, also in the process of developing spatial planning documents by communal authorities. Since the scope of such motions exceeds the scope of remarks and motions, as defined by the provisions of the law on spatial planning and development. Which entails the necessity to identify such remarks and motions separately in two ways, as they are differently regulated by procedures. Neither should be forgotten that social participation in the strategic procedure of the assessment of environmental impact includes not only society's rights, but the organ's duties as well. It is expressed by the obligation to announce the start of developing the strategic assessment of environmental impact, of the justification and summary of solutions adopted in the prepared document, and by the duty to provide information on the environment.
